1. Your Creative Content All Creative Content you choose to upload to the site remains your exclusive copyright and you retain all rights to your work.   RatedWriters.com is referred to below by its name or as ‘the website’

2. Your Account As a member please be aware you are responsible for maintaining the confidentiality of your account and password and agree to only use or access the website using one membership and its password. You can update your information on your member page as required.


3. Your Registration Information The registration information we receive from members helps us to personalise and continually improve your experience as a member on RatedWriters.com. We use information we receive to improve our services, prevent or detect fraud or abuses on our website, provide optional paid services and goods, and to enable third parties to carry out technical, logistical or other functions to enable the delivery of our site and services.

We comply with GDPR (General Data Protection Regulations) and treat your information in strict confidence.

5. Access to RatedWriters.com We endeavor to ensure that availability of the website is uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. By using the website your accept that the website and our services are provided as and when available and your access to the website may be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

You agree not to use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.

Definition "Your Information" is defined as any information you provide to us or other users in relation to the RatedWriters.com site and service including the registration, review process, listing of items for sale, including, without limitation, any description of items listed, and any other content that you post on the website other than your Creative Content. You retain all copyright and all other rights to your Creative Content. You are solely responsible for Your Information, and Your Information must not infringe any of the rules of conduct behaviour on the website listed above.

To enable RatedWriters.com to use Your Information on the site, you grant us a non-exclusive, world-wide, perpetual, irrevocable, royalty-free, sublicensable, through multiple tiers, license right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content throughout the world on our website and in any media. This is to enable the website to function and display Your Information on the website.

Due to the nature of the Internet and individuals differing creative and other opinions, RatedWriters.com cannot govern the responses to content you provide – be it reviews to your Creative Content, or other responses. You agree to waive your right to object to derogatory treatment or responses about your content or material. You accept that responses from others to any content you may upload or otherwise make available on the website will come in different forms – some negative as well as others that are constructive and positive. You also accept that members will upload varying types of Creative Content and other content on the website, and that Rated Writers cannot monitor the content that it uploaded because of the large amount of submissions we receive. While the majority of submissions to RatedWriters.com are very mainstream, you accept that Creative Content and other content may at times have content that some may find objectionable and that Rated Writers is not responsible for such uploads to the website. You accordingly agree to waive your right to object to derogatory material. By using this website, you agree to accept such risks as outlined here, and agree that RatedWriters.com is not responsible for the acts or omissions of users and members on the website and agree not to hold RatedWriters.com – its owners, workers and all third party providers such as our development and hosting company - legally or financially liable for  Creative Content and other content added on the website.   If you are a parent or guardian who has enabled a child in your care to use the website you agree to these terms and conditions and to monitoring your child’s use of this website as appropriate to their age.

8. Website Usage Policies 

By using the website, you agree to abide by these rules of conduct.

You agree not to post any material which is: 

·  Inaccurate and/or defamatory

·  Abusive, obscene, harassing, racist or generally offensive

·  Sexually explicit or inappropriate

·  Invasive of a person's privacy or private life

·  Illegal under copyright law

·  Use inappropriate or offensive user names

·  Use multiple logins to cause confusion or for any other purpose

·  Include another individual's contact information and/or email address

·  Send spam to other members

All member messages and other content including Creative Content are the responsibility of the member who added the content to the site, and by using the site you agree that Rated Writers and its affiliates are not responsible for any content including any messages from members to you, links to third parties or content added by members in general on the website. You accept that Rated Writers reserves the right but not the obligations to move or delete any content or message that, in our opinion, contravenes our site terms and conditions or Privacy Policy. You accept by using the website not to hold Rated Writers responsible for members’ messages, Creative Content, or any other content, and that Rated Writers is not responsible for any such content added by Rated Writers members or any other party. By using the website, you agree that all such content is the sole responsibility of the members that posted or added the content to the website and accept that RatedWriters.com is not liable legally or financially responsible for the acts or omissions of members on the website by their adding of content to the website. You accept Rated Writers reserves the right to suspend or remove members who, in the website’s opinion, contravene the website’s terms and conditions, or as the website otherwise deems appropriate, and accept that Rated Writers reserves the right to suspend or remove content members add to the site. You agree not to hold Rated Writers legally, financially or otherwise liable for any such actions.


The rules of conduct are in place for the site to help ensure the website is a positive and informative experience.

9. Member Warranty
You represent and warrant that you own or otherwise control all of the rights to the Creative Content that you upload or post to the website; and that, at the time that your content or material is added to RatedWriters.com that the content and material you provide does not breach any applicable RatedWriters.com policies or guidelines as outlined in these terms and conditions, and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify RatedWriters.com and its affiliates for all claims brought by a third party against RatedWriters.com or its affiliates arising out of or in connection with a breach by you of others copyright or a breach of any of these warranties. You grant RatedWriters.com the right to help publicise you and the site through the Creative Content that you add to the site, and to display your Creative Content and other content on the website. If you decide to remove your Creative Content from the site Rated Writers you agree to do this by the applicable delete content or membership functions for extracts on your member pages or via the Menu button on your member pages. We will endeavor to remove the content you click to remove in approx. 24 hours from when you click to remove it. You agree not to hold Rated Writers legally, financially or otherwise if it takes longer than this, for example, due to, but not limited to, site technical issues or site updating.

10. Professional Critiques for Creative Writing members
Each quarter, the three highest rated authors of fiction or non-fiction writing will each receive one free critique from a literary professional of approx. one and a half to two pages, and the seven next highest rated authors will receive a free mini-critique consisting of approx two paragraphs each from a literary professional.  The quarterly critiques will be based on the highest rated extracts of the preceding full 3 months. For example, April’s quarterly critiques will be awarded based on the charts from the start of January through to the end of March . The winners of the critiques will be based on the chart scores from reviews of extracts by members from the quarterly period and other assessment factors to determine the winners.  The winners may at times include extracts that were not in the applicable quarter’s Top Tens. For example some creative extracts may not have reached the Top Ten in a particular month but may have scored higher than the preceding month’s Top Ten extracts.  You accept that no correspondence will be entered into in respect of the extracts that are awarded critiques and to abide by the website’s decision on creative extracts that are awarded literary professional critiques.

11. Optional Paid Memberships and Paid Competitions
RatedWriters.com offers optional paid memberships and paid competitions.  For optional paid memberships, the services are available as offered and displayed on the website and the website may at times change the features and availability of optional paid memberships. By choosing an optional paid membership you accept that the website cannot guarantee reviews of your Creative Work are received within any particular time period, or the quality, length or amount of reviews for ‘review credits’ that are part of paid optional memberships, or when and how long it will take for reviews of your extract(s) to be sent by other members. This is because this is dependent on the participation of other members who review extracts on the site including your work and the amount of members participating on the site at any one time.  You accept by choosing an optional paid membership that refunds for the optional paid membership(s) you choose cannot be made for:  the time it may take for other members to review your Creative Work, or the quality, length or amount of reviews you receive or any other facet of the reviews you receive. You accept that optional paid membership(s) you choose cannot be refunded for any other reason related to the facets and features of the optional paid memberships on site. You accept by choosing an optional paid membership that features of that paid membership may not be available at all times, for example due to reasonable programming work or updating of the site and its features or other facets and agree not to hold the website responsible for refunds for such issues which the website will always attempt to remedy to resume normal service and features.


Paid Competitions.  By participating in optional paid competitions on the website you accept that the competition results will be based on chart scores from reviews of extracts by members and/or other assessment factors to determine the winners including decisions made by the website and/or literary or other professionals.   You accept by entering a paid competition on the website that no correspondence will be entered into in respect of the extracts that are winners of competitions, and to abide by the website’s decision on the winners of competitions. You accept by entering a paid competition that refunds cannot be given for your competition entry based on any of the above facets, or based on the amount of reviews you may receive for your entry into a paid competition, or based on any other facet including, but not limited to, the length, ratings or quality of reviews you receive or any other facets to do with the reviews and ratings. This is because reviews are dependent on the participation of other members who review your work and the amount of members participating on the website at any one time.  You agree that a refund cannot be given for your paid competition entry if: you do not participate in a paid competition by not reviewing other members extracts in order for your own extract to be sent out for review; or if competition extracts are assigned for review and rating by other Creative Medium members, or if your competition extract is assigned alongside other competition entrants for review and rating, or assigned alongside other non-competition extracts for review and rating, or if you are not satisfied with the amount of reviews, quality of reviews, length of reviews, or other review facets such as whether you are reviewed based on optional paid membership credits you have attached to your competition extract, or whether your competition extract is reviewed as a result of reviewing other members extracts in the website’s review exchange process.   For paid competitions involving questions to which competition entrants guess or select an answer to enter the competition you accept that no correspondence will be entered into and no refund given in respect of the winners of competitions, and agree to to abide by the website’s decision on the winners of competitions

12. Correspondence with RatedWriters.com
Visitors and website members agree not to submit, post, or send any submissions of a creative nature other than the creative areas currently enabled on the website. The creative submissions enabled on the website may only be added to the website in the upload formats permitted on the site. If you send us any other unsolicited submissions in any other format – either by submitting them to any part of the site, posting them by mail, or forwarding them to us by any other means, you accept that we take no responsibility for, and have no legal or financial liability in respect of the unsolicited submission in part or in whole, and reserve the right to remove unsolicited items. If you send us unsolicited submissions you release RatedWriters.com from any claims that can be made in respect of your unsolicited submissions.

13. Age Conditions
If you are under 18, you may use RatedWriters.com only with the involvement of a parent or guardian.  If you are a parent or guardian assisting a member’s involvement with the site in any respect, including by the upload of Creative Content or other content then you agree to abide by all the terms in these member terms and conditions and the website’s Privacy Policy.

14. Licence for website access
RatedWriters.com grants you a limited licence to access and make personal use of this website, you agree not to copy, reproduce, modify, or otherwise adapt the website or any portion of it in website, app or other form, and agree not to create a derivative website, app or other application based on this website.  You agree not to distribute or publicly display any content which isn’t permitted, except with the express written consent of RatedWriters.com or any applicable third party we deem affiliated with the site. The limited license to use this website does not include any resale or commercial use of this website or its contents; or any collection and use of any product listings, Creative Content, descriptions, or prices; any derivative or otherwise negative use of this website or its contents; or any downloading or copying of account information for the benefit of another business, merchant or other entity. You agree that you will not use any robot, spider, scraper or other means to access the website for any purpose without our express written permission. Additionally, you agree that you will not undertake any activities that results, or may result, in our sole discretion, to an unreasonable or disproportionately large load on our infrastructure. You agree not to interfere or attempt to interfere with the proper working of the website or any activities or processes conducted on the website.

You are given permission for a limited, revocable, and non-exclusive right to create a hyperlink to RatedWriters.com as long as the link does not portray RatedWriters.com, its affiliates, or their and our sites, products or services in a false, defamatory, misleading, or otherwise offensive matter. You may not use any RatedWriters.com logo or other proprietary graphic, trademark or other site material to infer any type of business, legal or other relationship with the website. All content on the website created by RatedWriters.com or its affiliates, including, but not limited to, text, graphics, digital downloads, data compilations, software or any other content or material is the property of RatedWriters.com, its affiliates or its content suppliers and is protected by United Kingdom and international copyright and database right laws. You may not use any meta tags or any other "hidden text" utilising RatedWriters.com or its affiliates' names or trademarks without the express written consent of RatedWriters.com.  RatedWriters.com trademarks may not be used in connection with any product or service that is not RatedWriters.com’s in any manner that is likely to cause confusion among, or in any manner that disparages or discredits RatedWriters.com. All other trademarks not owned by RatedWriters.com that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by RatedWriters.com. You agree you will not create or make available your own database that features substantial parts of this website or its concept and intellectual copyright without RatedWriters.com’s express written consent. You agree you will not extract or re-utilise parts of the contents of the Site without RatedWriters.com’s express written consent, including, but not limited to extraction or re-utilisation of data, or concept or intellectual copyright, by any Ai, data mining, robots, or similar data gathering and extraction tools.  You also may not create and make available your own database that features parts of this website or its concept or intellectual copyright without RatedWriters.com’s express written consent.

Any unauthorised use of the website terminates the permission or license granted by RatedWriters.com and you accept we reserve the right to refuse access to the website, terminate accounts or remove or edit content.

If you should lose access to your email address please note that we cannot provide access to your account as this involves providing access to any new member email address you may have and you accept that we cannot verify and are not responsible for verifying your identity as a result of a loss of your access to a membership account. This includes that you accept we cannot refund any services as a result of your loss of access to an email address that you used to login to your membership. In these circumstances you should join with a new email address.

15. Product and Service Ordering
When you place an order to purchase a product or service from RatedWriters.com, we will send you an e-mail confirming receipt of your order and containing the details of your order.  We cannot resend receipts that your email service provider may have filtered so in these circumstances you agree that you will access your required receipts by download your receipts from your member page.  For third party services or products you purchase via links from our website which are not part of our website or organization you agree that we are not responsible, legally, financially or otherwise for any services or products you purchase on websites, apps, platforms or organizations that may be linked from our website but which are not part of our website or our organization.

16. Pricing of Products and Services and availability
We list availability information for products and services sold by us on the website, this is included on product and services information pages on our website. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability and periods of service.


Conditions Relating to Both Your Use of RatedWriters.com and Sales to You

17. Under 18’s and purchase of services
RatedWriters.com does not sell products or services for purchase by under 18 year-olds and only sells products and service for purchase by adults. If you are under 18, you may use RatedWriters.com only with the involvement of a parent or guardian.

18. Other businesses and sponsors
Parties other than RatedWriters.com and its subsidiaries may operate stores, provide services, sponsor sections, or sell product lines on this website. We provide links to the websites of applicable companies or other separate businesses. You accept we are not responsible for examining or evaluating the aforementioned businesses, and we do not warrant or endorse the services, products or offerings of any of these businesses or individuals, or the content of their websites. You accept that RatedWriters.com does not assume any responsibility or liability for the actions, services, products or any content of any of these businesses, individuals, or of any other third-parties, and you should carefully review other individual’s, organisations or third parties privacy statements and other conditions of use. For example, if buying a product or service mentioned on our website on a third-party website or other platform.   We may share customer information related to transactions with applicable third-parties in order to fulfil the delivery of our services and projects.

19. Disclaimer
We will not be responsible for any business loss (including but not limited to loss of profits, revenue, contracts, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods or services by us to you was formed. We will not be liable for any loss of goodwill or reputation, or any special, indirect, or consequential damages (however arising, including negligence) arising out of or in connection with these conditions of use. Your membership will be subject to the policies and the Terms and Conditions of use in force at the time that you choose to use or continue to use the website, or choose to order goods or services from us, this will apply unless any change to those policies or terms and conditions is required to be made by us by law or government authority. If any of these conditions is deemed invalid, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions. Any notifications or communications that we may subsequently send you will be deemed to have been given to you if sent to your registration email address, which it is members’ responsibility in continuing their membership of the website to keep up to date, or deemed to be given to you if we update our terms and conditions and you continue use of the site.

22. Your Acceptance of This Agreement
This Agreement, together with any agreement referred to within the above text, including the Privacy Policy, and any other agreement made between you and RatedWriters.com, comprises the entire agreement between you and RatedWriters.com. Your registering to use the website and its services, or other access and use of the website and its services, constitutes your agreement to be bound by this Agreement and the terms therein, and constitutes the same effect as you having signed the Agreement manually. Any notifications or communications that we may subsequently send you will be deemed to have been given to you if sent to your registration email address, which it is your responsibility to keep up to date. We are under no obligation to make subsequent verification of notification or communications by any means if your email is not functioning or does not receive our email or is filtered out by your email providers. If a need arises for us to request you sign a printed copy of this agreement, you agree to be bound by this stipulation. Any arbitration that arises out of any legal dispute connected with this agreement will be conducted in accordance with the terms described within the agreement.

23. Events beyond our reasonable control
You agree we will not be held responsible for any delay or other failure to comply with our obligations under these terms and conditions if the delay or failure arises from any event or cause which is beyond our reasonable control or which may be deemed reasonable, for example, if the website requires updating. This condition does not affect your statutory rights.

24. Governing law and jurisdiction
This User Agreement shall be governed by and construed in accordance with English law and subject to the jurisdiction of the English courts. You agree, as do we, to submit to the non-exclusive jurisdiction of the English courts.
